On the note of a TM re-make....

So I heard that there were plans around here to make a TM game remake. I even re-call some people starting a project like this. Whatever happened to them?

Additionally, is this legal or should one expect a letter from "Take-Two"? If it is legal, how would one go about getting the original voice recordings and the like?

Just doing some research. I am looking to get a job in the game industry, but I do not have any "game" related experience, just IT. With that in mind, I was hoping to start something. A small project of sorts. Anyway, if someone could hel me with the above questions, that would be great.

ok...since that did not get much of a response, how would people feel if someone were to take the radio episodes and make them into some sort of playable form?

There was probably no response because none of us know the answer to your question. I think we had some sort of informal permission to make an original TM game as long as we didn't do anything to damage the franchise.

A remake, in order to make the old games runable on modern computers, is what I personally would most like to see (more than a new game.) But that might be a more touchy subject since there would obviously be a copyright violation there. We would have to get permission. An original game would be more of a trademark violation, and probably much easier to get clearance.
Hmm....interesting. Well, I would not mind reaching out to the right people in order to get this response. Should I be contacting Take 2? (Since this is where I heard Tex ended up last.)

I'm not positive, but last I heard Take-Two does own the rights, but it's not fully aware of it. Therefore it may not be wise to shed light on this matter to Take-Two for the time being as it may find it's sitting on a gold mine...

We don't know if Take-Two supposely owns 100% of Tex Murphy names. Maybe Indie Built Inc. signed all contact names of Tex Murphy to AC before IB Inc. shut down as he was given notice. We don't know if they own it or or AC owns itt?
Do we have any contact information for AC?

the rights dotn matter as long as we do not make money off of it and recognize (meaning make sure people know we do not own the copyright to the characters/story etc...) there is an interesting "fan fiction" loophole in copyright laws. we basically have free reign to do what we want as long as we dont not iontend to sell the product. if its free, and all copyrights are recognized we are in the clear

My concerns stem from the fact that I heard of a project that tried to create Stargate Mod. Essentially, they were planning to make it available, but they still got a letter to stop what they were doing or else they would face legal issues. I don't particularly want to deal with that.

my guess is that Take 2 still owns Tex Murphy. Why would they give it to Aaron? We don't care enough about you to keep you employed...but here's a consolation prize. Nah!

Only money will get Tex back to it's "rightful" owners. How much? I don't know. Sad to say but at the moment I'm a 999,999 short of my first million. :P jk 995,100. or so..... but I got as FAT credit line. heehee.

Is Take 2 going to care about fan fiction, or a fan game? My guess is doubtful. Especially if it means that the property might be able to earn them a few more bucks at the selling table.

I'm not a gloom and doomer....I think it's possible for the rights to get back to the "Big 3". But it's a matter of timing and finances, none of which we're privy too.

BUT... I keep the faith!

Umm... I'm not too sure of that... :? In fact, I'm pretty darn sure you're wrong on that one.... I couldn't find anything on the copyright.gov website that had anything about fan fiction. Although it's not for profit, it would be real shady. I wouldn't bet on it without permission.

If any non-profit game were created and distributed, I would bet all the pedestrians in New York City Take 2 would be on us like flies on poop.

I'd love to work on it anyway, though, and I'm sure something could be arranged if we did make anything that became popular.
I believe tevih's right. It's probably a bit more complicated. Remember the problems the makers of the Kings Quest fan game ran into? I believe the men in charge finally caved in and allowed the making of the game, with a name change.

I'm guessing the mod would be in the clear if it was called just UAKM for instance, and didn't include audio sampled from the original game (or other content taken directly from the game).
Although ActiVision owns the rights to the Zork series, there have been several fan-produced games based on that series. I know that some of the developers got permission from ActiVision and some didn't. To the best of my knowledge, none of the developers (with permission or without) received any trouble from ActiVision.

But that's ActiVision. Take2 may be harder (or easier) to deal with.

I think that, so long as the fan-game doesn't degrade or disparge the memory of the TM series and remains consistent with the TM universe and time-line, Take2 has everything to gain and nothing to lose. It's free publicity for one of their titles, plus it's a no-cost, no-risk test marketing operation for them. They just might go for it. They might even sub-contract you.
If by everything to gain, you mean: Take 2 automatically takes control of a fan-made game which has become popular and Take 2 turns a nice profit leaving the fans who created it to scrounge for breadcrumbs behind the refrigerator, you'd be correct.

If they own the copyright and there's no agreement signed beforehand, it's all theirs.
