i just saw on this abandonware (not warez) site that uakm will be uploaded on this site. (because of the fact that the game is no more sold...)

About "coming soon" games, here is a little list :

It's a gray area.
I've been around the abandonware ring and i enjoy that French Kiss site because is has games avaliable that arn't esa approved.
Other sites only have esa approved games and while there are some decent games that are esa approved, all the really good ones in my opinion arn't.
I'm not full sure, but from what i've seen, most games that arn't esa approved arn't even for sale anymore. Why can't it be abandonware then? The companies just want to hold onto their licenses i guess. :/

This is one of those hot button issues on some places on the net. However the copyright holder has the legal right to not sell as well as sell its property. For someone to allow downloads of them without the written permission of the copyright holder is illegal. Wheither or not someone has "abandoned" the game or not is completly irrevelant when it comes to the law. At times creators of older titles have obtained permission from copyright holders to allow downloads. But for the most part companies retain and restict those rights out of common practice. One thing to keep in mind however is that law is only words unless its enforced. So for the most part if you are allowing a download of an obscure game that the copyright holder has long forgotten about then you will probably not be in trouble (probably). In my own personal opinion, the term abandonware when it comes into this grey area is befitting to those who cannot stomach the conscience to believe that copying the game is still costing the developers money.
Abandonware is in action when the producers of the game no longer profit from its sales. Any title that still brings a percentage of its sale price to its producers is not abandonware and it is still illegal do obtain copies this way.
That's as far as I know, based on the legal side of things.

I agree, the only way I dont see harm is if the company has released permission for the game to be added to a list. Although I wish more companies would do so. Most offered life time guarantees on software, and most no longer honor those agreements. So if you purchased copies of these games and your disks went bad then you have only 2 choices, buy it on ebay or download it.
Agrees with Demonlawyer. I'd just hope people would buy it! My fourth disc has become unusable, and I'm looking to just buy another copy, and I've already bought it at least twice before. So, I have to assume that someone still wants to keep buying it, if not just us tex-inites looking for another copy.

Edit: McDonis, I was just looking at the memberlist and you're just a spit in a throw from Dayton in Columbus. One of my brothers actually lives in CBus. Small world, eh?

When I joined the Army (long ago and in a land far far away) I went to boot camp in South Carolina. One of my drill sgts was from a town just down the road from mine. And like me he was in high school band there. Go figure.
Once I toured a navy ship in Baltimore and the person in front of me in line in the tour was from the same town I was. We just both went to the same place at the same time. (my home town is very very very small)
